SC notice issue on Omar Abdullah’s custody

New Delhi: The Supreme Court will hear on March 2 on a petition challenging the case of detention of National Conference leader Omar Abdullah under the Public Safety Act. The bench of Justices Arun Mishra and Indira Banerjee today fixed the hearing date for this petition.

The matter of detaining Omar Abdullah under the Public Safety Act was challenged by his sister Sara Pilot. The Supreme Court has issued a notice to the Jammu and Kashmir administration on the same petition filed by Sara. Senior advocate Kapil Sibal had appeared for the court on behalf of Sara Pilot.

Sara Pilot had on Monday approached the apex court challenging her brother’s detention under the Public Safety Act. The petition stated that the detention order was “manifestly illegal” and there was no question of it being a “threat to the maintenance of public order”. Sara has petitioned for the release of her detained brother Omar Abdullah.

A new bench of two judges had to be set up to hear the petition as Justice MM Shantanagoudar, who was earlier in the bench, had dissociated from the hearing in the case without giving any reasons before the hearing. Sara Pilot’s petition was earlier held by a three-member bench of Justice NV Ramanna, Justice MM Shantanagoudar and Justice Sanjeev Khanna.

Omar Abdullah has been detained under the Jammu and Kashmir Public Security Act 1978.
